SUPPLEMENTAL GERSTEIN 



On Monday, August 29, 2011 at approximately 2230 hours W-l and W-2 were working the 1430-2300 
hours tour of duty in the 5th District. W-l & W-2 were parked in the 1900 block of Bennett Place 
Northeast, Washington, D.C. in a marked Metropolitan Police Department scout car wearing full ' 
uniform. W-l & W-2 responded to a radio run for a disorderly in the 1900 block of Bennett Place 
Northeast. While sitting in their vehicle, W-l and W-2 observed the defendant wearing a mask la'ter 
-dentrfted as (Anthony Hatton) armed with a black handgun chasing a black male later identified as Tyrell 
Fogle westbound in the 1900 block of Bennett Place, Northeast. The defendant (Hatton) was firing 
several rounds at the victim. W-l and W-2 pursued the defendant (Hatton) eastbound in the 1900 block 
o Bennett Place Northeast in a marked scout car. The defendant (Hatton) ran northbound in the 700 
block of 21st Street Northeast, and then eastbound through the rear alley of the 2100 block of H Street 
Northeast at which time W-2 exited the marked scout car and began to pursue the defendant (Hatton) 
on foot. The defendant (Hatton) was apprehended in the field behind the 700 block of 21st Street 
Northeast. Officers located a black 9mm Beretta, model 92D Centurion bearing serial number ' 
BER158807 loaded with (11) live rounds of 9mm ammunition next to the defendant (Hatton) The 
weapon appeared to be operable and capable of firing a projectile. Officers located the victim (Tyrell 
Fogle) m the 1900 block Bennett Place, Northeast suffering from multiple gunshot wounds to the body 
Officers also located multiple expended 9mm shell casings in the area where Wl & W2 observed the ' 
defendant (Hatton) firing his weapon. The victim (Fogle) was transported to Washington Hospital 
Center MedStar Unit by Ambulance 30. The victim (Fogle) was subsequently pronounced dead at 2310 
hours by Doctor Shifflett. The defendant was arrested and charged with 1st Degree Murder While 
Armed
